Killer Sigfredo Garcia is appealing his Prison Sentence for shooting Professor Dan Markel dead. SIGFREDO GARCIA'S APPEALING HIS PRISON SENTENCE FOR THE SHOOTING OF PROFESSOR DAN MARKEL –A MURDER FOR HIRE The public were not surprised to learn that Sigfredo Garcia is to appeal his prison sentence. Criminals are always astutely aware of THEIR RIGHTS. Were he himself responsible for his own attorneys’ legal fees, it might be another matter. I pray that when the Appeal Court hears this appeal they will dismiss it and give him no possibility of taking it to the Supreme Court, wasting even more taxpayers’ money. I wish to see Dan Markel’s family granted permission and Legal Aid to appeal to the court also. Permission to appeal is only granted on a point of LAW. We await the judicial contortions of the defence attorneys. We note that they had been paid handsomely by anonymous donors to represent Sigfredo Garcia. We understand that one of his attorneys are allegedly from the law chambers of the Adelson Institute representative attorneys. If they request to remain Garcia’s attorneys at the Appeal Court hearing if they succeed in their application, this is understandable as they would have to scour their own defence papers and scrub out all the questionable writings thereto. This will require a team of lawyers to examine every single bit of paper they hold on this case and, should any misfeasance be found among notes, etc, there could be attorneys in the DOCK also. Concerning that truly biased and illogical expert witness psychologist female who spoke at trial with such tender sympathy for Sigfredo Garcia: Lady, your statements in court appeared to me to be biased, illogical, unscientific and of much hocus-pocus, if I might state my personal feeling about this public opinion you gave of Sigfredo Garcia. Let’s just open all the jail gates and let all the thieves and murderers go free –to plunder and pillage again, why don’t we?? Garcia was not depressed, ill or sorry for himself –with no money to pay for medical insurance. Look at him. A big, very strong, blank looking idle man awaiting his speedy return to the streets of Miami in order to continue his modus operandi-thieving, robbing, drug-taking, illicit way of life. His defense team thought of the wheeze of having his dress as if he were an attorney. It worked. They all looked the same- unethical, and lying through their teeth. The facts are that Garcia killed Dan Markel by shooting him twice precisely where he wanted him shot- in an evil, cold-blooded, vicious and unexpected way that abruptly caused a cessation of Professor Dan Markel’s legal career and life. Dan Markel’s prolific legal career was thus cut short. Dan Markel has been criminally robbed of seeing his two young sons grow up. The psychiatric term for his behaviour is known as RECIDIVISM. MALINGERING Normally, the Court does not decide on whether someone is a malingerer. But a FORENSIC process is used for the finding of FACT. This forensic process deals with the evidence at trial. The word MALINGERING is not a distinct legal concept, but lawyers in JEFFRIES v HOME OFFICE (unreported) March 26, 1999, Queen’s Bench Division, stated that a MALINGERER is "one who deliberately and consciously adopts the sick role, if necessary, deceiving his medical advisers, to persuade them that his complaints are true". DANGEROUS-NESS The court is most concerned with the dangerousness of a person who is convicted of shooting a total stranger with two bullets precisely aimed at his head, simply for monetary recompense. For a considerable time, future dangerousness has been recognized as a decisive or at least relevant consideration in several kinds of statutory provisions to do with sentencing and some jurisdictions have taken up the broader drafting of the Model Penal Code and provide generally for the imposition of lengthy sentences on mentally abnormal dangerous offenders….
