This MuchLoved.com Internet tribute was created by Sally S Ramage as a memorial site for Criminal Law Professor Daniel Eric Markel, aged 41, who was born in Toronto, Ontario, Canada on 9 October 1972 and who was murdered by gunshot at his home one summer's day in July 2014 .He is much loved by his two very young sons, his parents, his sister and his colleagues and friends around the world and at Florida State University. He will forever be remembered especially because of the evil, cold-blooded, vicious and unexpected way that his prolific legal career has been cut short and also because he has been criminally robbed of seeing his sons grow up and his sons in turn have been robbed of their very loving father. Time will reveal more and more about this CONSPIRACY TO MURDER and the Tallahassee murder of this young criminal law professor, ripped from this earth. Such a travesty; such injustice; such wanton waste of a focussed, hard-working, good life.
We hope that you will visit Professor Markel's memorial website frequently and draw respect for America's Criminal Justice System which WILL win; and draw comfort, humanity, and passionate enthusiasm for the RULE OF LAW.
For the United Nations, the Rule of Law refers to a principle of governance in which all persons, institutions and entities, public and private, including the State itself, are accountable to laws that are publicly promulgated, equally enforced and independently adjudicated, and which are consistent with international human rights norms and standards, requiring measures to ensure adherence to the principles of supremacy of law; equality before the law; accountability to the law; fairness in the application of the law; separation of powers; participation in decision-making; legal certainty; avoidance of arbitrariness; and procedural and legal transparency.(See Mooney, L. (Ed) (2013) Promoting the Rule of Law, US: American Bar Association).
Please note that creating this memorial website as a mark of respect to Criminal Law Professor Daniel Eric Markel has cost me simply hundreds of hours of time away from my own criminal law books, papers and criminal law book reviews. Therefore we hope that "it speaks for itself" (res ipsa loquitur). We pray that all conspirators will swiftly be brought to justice and receive heavy punishment for wiping out this hard-working attorney. R.I.P. We especially pray for God's guidance for the prosecutor of this very sad case.
It is as well to remember these words from The American Bar Association's E-Discovery (2017):
"Justice is based on truth, on what really happened. That is a basic problem in law because facts are usually contested. Each side has their own story. The truth is out there, but requires search to discover. Truth and justice thus depend upon effective search.
Truth in the law means objective, reliable facts that may be admitted as evidence in a trial. The testimony of witnesses is by nature inherently subjective. Testimony alone is an unreliable path to truth. ...
Judge and jury must guess at who is lying. They are susceptible to lies, clever arguments, false hunches, publicity, and political pressures..."
I will never forget the moment I first heard the news. I was stunned and remain stunned because the apparent mindset of those guilty persons is simply selfish greed and self-pleasures, rather than the pursuit of truth through careful study and back-breaking diligence.
