The law's history since Coke defines mens rea as malice aforethought, which distinguishes  murder from involuntary manslaughter.

Over time though, the mens rea for murder has come to mean-not malice-but intention. Today, murder is widely thought to be the

gravest of crimes, unlike in the years before the year 1957, malice aforethought for murder was defined as express, implied or

constructive.
